Terms of Service

These Terms of Service ("Terms") govern your access to and use of Leadpocket (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Leadpocket is a mobile-first CRM that lets you collect leads through QR-code intake forms, manage them, and follow up through messaging apps, optionally assisted by AI. We may improve, add, or remove features over time.

2. Your Account

You must provide accurate information when signing up and keep your password secure. You are responsible for all activity under your account. You must be at least 18 years old (or the age of majority where you live) to use the Service.

3. Free Trial

New accounts receive a 3-day free trial with full Pro access. No payment method is required for the trial. When the trial ends, a paid subscription is required to continue using the Service; your data remains available for export either way.

4. Subscriptions & Billing

• Paid plans (Lite and Pro) are billed monthly or yearly, in advance, through Stripe.
• Subscriptions renew automatically until canceled. You can cancel anytime from the Billing page; access continues until the end of the period you've paid for.
• Plan limits (such as daily lead captures, number of forms and flows, and AI access) apply as described on the pricing page and may be enforced automatically.
• We may change prices with at least 30 days' notice; changes apply from your next renewal.
• Except where required by law, payments are non-refundable; we may grant refunds at our discretion.

5. Your Content & Data

You own the data you collect through the Service — your leads, forms, flows, and notes. You grant us only the limited rights needed to store and process that data to operate the Service for you. You can export your leads at any time and can permanently delete your account and all its data from Settings.

Where data protection law (such as the GDPR or UK GDPR) applies to the lead data you collect, you act as the controller and we process it on your behalf under our Data Processing Agreement, which is incorporated into these Terms by reference and includes our subprocessor list.

6. Acceptable Use

You agree not to use the Service to:

• collect personal information from people without an appropriate legal basis or send messages to people who have not consented to be contacted, where consent is required;
• send spam, unlawful, deceptive, or harassing messages (you are responsible for complying with applicable messaging laws, such as the TCPA and CAN-SPAM in the United States);
• violate any law, infringe anyone's rights, or upload malicious content;
• probe, disrupt, or attempt to gain unauthorized access to the Service or other users' data;
• resell or white-label the Service without our written permission.

7. AI Features

AI-generated messages are suggestions produced by a third-party model. They may be inaccurate or inappropriate for your context. You are responsible for reviewing every message before sending it. AI features depend on a third-party provider and may occasionally be slow or unavailable.

8. Availability & Changes

We aim for high availability but provide the Service "as is" and "as available," without warranties of any kind, express or implied. We may modify or discontinue the Service (or parts of it) with reasonable notice where practicable.

9. Limitation of Liability

To the maximum extent permitted by law, Leadpocket and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the twelve months before the claim arose.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, with notice where practicable. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as Sections 9 and 11) survive.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app or by email at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
